Madduck.com.au is an Australian online print-on-demand store offering custom printed and made-to-order products, including T-shirts, hoodies, sweatshirts, tote bags, coffee mugs, caps, hats and related products. Many Madduck products are printed or made after an order is placed. Because products are made to order, there may be normal production variations between website images, mockups, previews and the finished product.

5. Customer-submitted content

You are responsible for all Customer Content you submit to Madduck.com.au. By submitting Customer Content, you confirm that:
- you own the Customer Content, or you have all rights, licences, permissions and consents needed to use it;
- the Customer Content does not infringe copyright, trade marks, design rights, moral rights, privacy rights, publicity rights, image rights or any other rights of another person or organisation;
- you have permission to use any name, image, photograph, likeness, logo, brand, artwork, quote, slogan or design included in the Customer Content;
- the Customer Content is lawful and suitable for printing;
- the Customer Content does not contain private, confidential or sensitive information unless you have permission to use it;
- the Customer Content does not breach our Terms and Conditions or any applicable law.
If you are unsure whether you have permission to use particular content, please do not upload it or ask us to print it.
6. Licence to use Customer Content for fulfilment
You retain ownership of any rights you have in your Customer Content.
By submitting Customer Content to Madduck.com.au, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, format, store, transmit and display that Customer Content only as reasonably necessary to:
- prepare product previews, mockups, proofs or print files;
- print, produce, package and fulfil your order;
- communicate with you about your order;
- manage quality control, reprints, replacements, refunds, returns, disputes or support requests;
- comply with legal, tax, accounting, fraud prevention or regulatory obligations.
We will not use your personal custom artwork, photographs, names or personalisation for advertising, website galleries, social media or promotional purposes unless you give us permission or share the content publicly yourself.
7. Prohibited content
We may refuse, remove, cancel or decline to print any order or Customer Content that we reasonably believe:
- is unlawful, fraudulent, misleading or deceptive;
- infringes copyright, trade marks, design rights, privacy rights, publicity rights or other rights;
- uses a person’s name, image, photograph or likeness without permission;
- uses a brand, logo, team, celebrity, character, artist, band, movie, TV show, game, quote, slogan or other protected material without permission;
- contains hateful, abusive, harassing, threatening, discriminatory, defamatory or bullying content;
- promotes violence, self-harm, terrorism, criminal activity, illegal drugs, weapons misuse or unsafe conduct;
- contains sexually exploitative, obscene or inappropriate material;
- contains private, confidential or sensitive information without permission;
- may damage our reputation, business, suppliers, fulfilment partners, customers or platform access;
- is technically unsuitable for printing or production.
We may also cancel, refuse or remove content where required by Shopify, a payment provider, a print partner, a rights holder, a regulator, a carrier or applicable law.
8. Madduck intellectual property
Unless otherwise stated, all content on Madduck.com.au is owned by or licensed to us. This includes our website content, product designs, predefined artwork, graphics, logos, illustrations, product images, photographs, mockups, text, layout, icons, videos, branding and other materials.
You may browse our website and purchase products for personal use. You must not copy, reproduce, modify, distribute, sell, exploit, scrape, download, reverse engineer, imitate or use any Madduck content, designs, graphics, branding or website materials for commercial purposes without our prior written permission.
