Welcome to Madduck.com.au. These Terms and Conditions (“Terms”) apply when you access our website, browse our products, create an account, place an order, submit artwork or personalisation, or otherwise use our online store.

Madduck.com.au (“Madduck”, “we”, “us” and “our”) is an Australian online print-on-demand store offering custom printed T-shirts, hoodies, sweatshirts, tote bags, coffee mugs, caps, hats and related products. Some products feature predefined images, artwork or graphics, and some products may allow customers to personalise the product with names, words, images, artwork, photographs, messages or other design elements.

By using Madduck.com.au, you agree to these Terms. If you do not agree, please do not use our website or place an order.

3. Eligibility to use our store

You must be at least 18 years old to place an order with us. If you are under 18, you may use Madduck.com.au only with the involvement and consent of a parent or guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account. You are responsible for ensuring that your name, email address, phone number, billing address, shipping address, product choices, sizes, colours, personalisation details and uploaded content are correct before submitting your order.

4. Products and product information

We aim to display our products, colours, artwork, sizes, descriptions, pricing and availability as accurately as possible. However, product images, colours and mockups are provided for general guidance only. Colours may appear differently depending on your screen, device settings, lighting, fabric, print method, product material and production process.

Because our products are printed on demand, small variations may occur between product previews, mockups and the finished item. These variations may include slight differences in print placement, scale, colour, texture, garment fit, fabric feel or product finish.

Sizing information is provided as a guide. Different garment styles, brands and product types may fit differently. Please check the available sizing information carefully before ordering.

5. Product personalisation and customer content

Some products may allow you to personalise an item by adding text, names, initials, numbers, images, artwork, graphics, photographs, logos, messages or other content (“Customer Content”).

You are responsible for checking all Customer Content before submitting your order. This includes spelling, grammar, punctuation, names, dates, image quality, image resolution, layout, colours, placement, size and any design instructions.

Once an order has been submitted, we may be unable to edit, cancel or change it, especially after production has started. If you notice an error, contact us as soon as possible at [insert contact email]. We will try to assist, but we cannot guarantee changes can be made after an order is placed.

If we provide a design preview, mockup or proof, it is your responsibility to review it carefully. Approval of a preview, mockup or proof means you accept the design as shown, subject to normal production variations.

6. Your rights and responsibilities for uploaded content

By uploading, submitting or requesting the use of Customer Content, you represent and warrant that:

  • you own the Customer Content, or you have all rights, licences, permissions and consents required to use it;
  • the Customer Content does not infringe any copyright, trademark, design right, moral right, privacy right, publicity right, image right or other right of any person or organisation;
  • you have permission to use any name, image, photograph, likeness, logo, brand, artwork, quote, slogan or design included in the Customer Content;
  • the Customer Content is lawful and does not breach any applicable law or regulation;
  • the Customer Content does not contain anything misleading, defamatory, abusive, harassing, threatening, discriminatory, hateful, obscene or otherwise unsuitable for printing;
  • the Customer Content is not counterfeit, stolen, copied without permission or supplied in breach of another person’s rights.

If you are unsure whether you have the right to use particular content, please do not upload it or request that we print it.

7. Licence to use Customer Content

You retain ownership of any rights you have in your Customer Content.

By submitting Customer Content to Madduck.com.au, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, format, store, transmit and display that Customer Content only as reasonably necessary to:

  • prepare product previews, mockups, proofs or production files;
  • print, produce, package and fulfil your order;
  • communicate with you about your order;
  • manage quality control, reprints, returns, refunds, disputes or customer support;
  • comply with legal, tax, accounting, fraud prevention or regulatory obligations.

We will not use your personal custom artwork, photographs, names or personalisation for advertising, public display, website galleries or social media promotion unless you give us permission or share the content publicly yourself.

8. Prohibited content

We may refuse, cancel, remove or decline to print any Customer Content or order that we reasonably believe:

  • infringes copyright, trademarks, design rights, privacy rights, publicity rights or other rights;
  • uses a person’s name, image or likeness without permission;
  • uses a logo, brand, team, character, celebrity, artist, band, movie, TV show, game or other protected material without permission;
  • is unlawful, fraudulent, deceptive or misleading;
  • promotes hatred, violence, harassment, abuse, bullying or discrimination;
  • is obscene, sexually explicit, exploitative or otherwise inappropriate;
  • promotes self-harm, terrorism, criminal activity, illegal drugs, weapons misuse or unsafe conduct;
  • contains private or confidential information without permission;
  • may damage our reputation, business, suppliers, fulfilment partners or customers;
  • is technically unsuitable for printing or does not meet our production requirements.

If we cancel an order before production because of prohibited content, rights concerns or technical unsuitability, we will refund any amount paid for the cancelled item unless we are legally entitled to withhold payment or unless the issue arises after costs have already been incurred and the law allows us to deduct those costs.

9. Intellectual property owned by Madduck

All content on Madduck.com.au, including our website layout, text, graphics, logos, product images, artwork, designs, illustrations, icons, photographs, videos, mockups, code, branding and other materials, is owned by or licensed to us, unless otherwise stated.

You may browse our website and purchase products for personal use. You must not copy, reproduce, modify, distribute, sell, exploit, scrape, download, reverse engineer or use our website content, designs, graphics or branding for commercial purposes without our prior written permission.

Purchasing a product does not transfer copyright, trademark rights or other intellectual property rights in any Madduck design, predefined graphic, artwork or website content.

10. Orders

When you place an order, you are making an offer to purchase the selected products on these Terms. We may accept or reject your order in accordance with these Terms and applicable law.

After you place an order, you may receive an order confirmation email. This email confirms that we have received your order, but it does not guarantee that the order can be fulfilled. We may cancel or refuse an order where reasonably necessary, including where:

  • the product is unavailable;
  • there is a pricing, product, shipping or technical error;
  • your payment cannot be processed or appears fraudulent;
  • your shipping details are incomplete, invalid or unsupported;
  • the Customer Content breaches these Terms or appears to infringe third-party rights;
  • the order cannot be produced to an acceptable standard;
  • fulfilment becomes commercially or technically impractical;
  • we are required or permitted to do so by law.

If we cancel an order after payment has been taken, we will refund the cancelled amount using the original payment method where possible, unless otherwise required or permitted by law.

11. Pricing, taxes and payment

Prices are shown in Australian dollars unless stated otherwise. Prices may include or exclude taxes depending on how they are displayed at checkout and whether we are required to charge GST or other taxes.

Shipping costs, delivery charges, taxes, duties or other fees may be added at checkout. You are responsible for reviewing the total order price before completing payment.

We may change product prices, promotions, discounts and shipping charges at any time. Changes will not affect orders that have already been accepted, except where there has been an obvious pricing or technical error and the law allows us to cancel or correct the order.

Payments are processed by third-party payment providers. We do not store full credit card details. Your payment provider may have its own terms, privacy policy and security processes.

12. Discounts and promotions

Discount codes, promotional offers, bundles, free shipping offers and other promotions are subject to any terms stated at the time of the promotion.

Unless stated otherwise, promotions:

  • are valid for a limited time only;
  • cannot be exchanged for cash;
  • cannot be applied retrospectively to previous orders;
  • cannot be combined with other offers;
  • may be changed, suspended or withdrawn where reasonably necessary.

We may cancel or refuse a promotion, discount code or order if we reasonably believe it is being misused, obtained fraudulently, applied because of a technical error or used in breach of the promotion terms.

13. Production and fulfilment

Madduck.com.au offers print-on-demand products. This means many items are made, printed or customised after an order is placed. Production times are estimates only and may vary depending on product type, order volume, artwork checks, supplier availability, equipment, public holidays, peak periods and events outside our control.

We may use third-party print, production, warehousing and fulfilment partners to produce and ship orders. You agree that your order information, shipping information and Customer Content may be shared with those partners as reasonably necessary to fulfil your order, in accordance with our Privacy Policy.

We reserve the right to substitute a blank product, garment brand, production method or fulfilment location where reasonably necessary, provided the substituted item is of comparable type and quality and does not materially reduce your rights under Australian Consumer Law.

14. Shipping and delivery

Shipping times shown on our website are estimates only. Delivery times may be affected by production times, courier delays, incorrect addresses, customs checks, public holidays, weather events, peak periods, natural disasters, industrial action or other circumstances beyond our control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed deliveries or additional costs caused by incorrect, incomplete or outdated shipping details supplied by you.

Risk in the product passes to you when the product is delivered to the address you provided, except to the extent otherwise required by law.

If tracking shows that an order has been delivered but you have not received it, please contact us promptly so we can investigate with the carrier where possible.

15. Customs, duties and international orders

If we ship outside Australia, your order may be subject to customs duties, import taxes, brokerage fees or other charges imposed by the destination country. Unless stated otherwise at checkout, you are responsible for these charges.

We are not responsible for delays caused by customs, border processing, import restrictions or failure to pay required import charges.

16. Cancellations and changes

Because many of our products are made to order, cancellations or changes may not be possible after an order is placed, particularly after production has started.

If production has not started, we may be able to cancel or change your order. If production has started, we may be unable to cancel, change, refund or exchange the item for change-of-mind reasons, subject always to your rights under Australian Consumer Law.

17. Returns, refunds and Australian Consumer Law

Nothing in these Terms limits, excludes or modifies any rights you have under Australian Consumer Law or any other rights that cannot lawfully be excluded.

Our products come with guarantees that cannot be excluded under Australian Consumer Law. If a product has a major failure, you may be entitled to choose a refund or replacement. If a product has a minor failure, we may be entitled to provide a repair, replacement or other remedy permitted by law.

Please contact us if your order arrives faulty, damaged, materially different from the product description, incorrectly printed, incorrectly supplied or otherwise fails to meet a consumer guarantee. We may ask you to provide your order number, a description of the issue, photographs, videos or other information reasonably needed to assess the problem.

Subject to Australian Consumer Law, we generally do not offer refunds, exchanges or cancellations for change of mind on personalised, customised or made-to-order products once production has started. This includes where you:

  • ordered the wrong size, colour or product;
  • entered incorrect personalisation, spelling, names, dates or design instructions;
  • uploaded low-quality, low-resolution or unsuitable artwork;
  • changed your mind after placing the order;
  • no longer want the item;
  • provided an incorrect or incomplete shipping address.

Where a problem is caused by our error or a failure to meet consumer guarantees, we will provide the remedy required by law.

18. Care instructions

You are responsible for following any care instructions supplied with the product or shown on our website. Printed garments and products may be damaged by incorrect washing, drying, ironing, bleaching, cleaning, storage, handling or use.

Subject to Australian Consumer Law, we are not responsible for damage caused by normal wear and tear, misuse, failure to follow care instructions, accidental damage, exposure to harsh chemicals, improper washing or improper storage.

19. User accounts

If customer accounts are available, you are responsible for keeping your login details secure and for all activity under your account. You must notify us promptly if you believe your account has been accessed without permission.

We may suspend, restrict or close an account where reasonably necessary, including where we suspect fraud, unlawful activity, misuse, security risks, breach of these Terms or abuse of our staff, systems, suppliers or customers.

20. Reviews, comments and submissions

If you submit a review, comment, photo, message, feedback or other public content to us or through our website, you grant us permission to use, display, reproduce and share that content for store, customer service, marketing and promotional purposes, unless you tell us otherwise in writing.

You must ensure that any review or public submission is truthful, lawful, respectful and does not infringe anyone else’s rights. We may remove or moderate reviews, comments or submissions that are abusive, false, misleading, unlawful, spam, promotional, irrelevant or otherwise unsuitable.

You must not misuse Madduck.com.au. You agree not to:

  • use our website for unlawful, fraudulent or harmful purposes;
  • attempt to interfere with the security or operation of our website;
  • upload viruses, malware, harmful code or automated scripts;
  • scrape, copy, harvest or extract website data without permission;

  • impersonate another person or provide false information;
  • use our website in a way that could damage our reputation, systems, suppliers or customers.

24. Security and availability

We aim to keep Madduck.com.au secure and available, but we do not guarantee that our website will always be uninterrupted, error-free, virus-free or available at all times.

We may suspend, withdraw, update or restrict access to all or part of our website where reasonably necessary for maintenance, security, technical, business or legal reasons.

25. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under Australian Consumer Law, we are not liable for any indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, loss of goodwill or business interruption arising from your use of our website or purchase of our products.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

26. Indemnity

To the maximum extent permitted by law, you agree to indemnify us against claims, losses, liabilities, damages, costs and expenses arising from:

  • your breach of these Terms;
  • Customer Content you upload, submit or ask us to print;
  • your infringement of any third-party rights, including copyright, trademark, privacy or publicity rights;
  • your misuse of our website;
  • your unlawful, fraudulent or negligent conduct.

This indemnity does not apply to the extent a claim, loss, liability, damage, cost or expense is caused by our own breach of law, negligence or failure to comply with Australian Consumer Law.

27. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, epidemic, war, terrorism, civil unrest, labour disputes, carrier delays, customs delays, supplier failures, production outages, equipment failure, internet outages, cyber incidents, government action or changes in law.

28. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date.

The Terms in effect at the time you place an order will generally apply to that order, unless a change is required by law or is necessary to protect our website, customers, suppliers or business from fraud, security risks or unlawful activity.

29. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or removed to the extent necessary, and the remaining parts will continue to apply.

30. Governing law
